Terms and Conditions

 

1. Our contract with you

1.1 We are Hire Me Moto Limited, a company registered in England with company number 11618326 (‘Moto101’, ‘we’, ‘us’ etc).

1.2 These terms and conditions (the ‘Terms’) apply when you hire one or more of our electric bikes and book either an arrive and ride session(s) or an experience day with us using our online booking system, or when you book with us in person or over the phone.

1.3 The Terms form a legally binding contract with you and the members of your party (if any). Do not book a session with us if you are not comfortable doing so on the terms and conditions set out below.

1.4 Please note that our liability is limited, and your attention is particularly drawn to clause 12.

1.5 We may occasionally make variations to these Terms. These will be published on our website but will not affect an existing booking. You may not vary the Terms without our written agreement.

1.6 Moto101 reserves the right to make changes to your hire sessions where, in our reasonable opinion, we have a good reason for doing so.  Where it is reasonably practicable to do so, we will notify you of any changes in advance and give you the chance to cancel and claim a refund if the change materially affects you.

2. Party Bookings

2.1 The Terms contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept the Terms before riding.

2.2 As the person making the booking, you agree and warrant to us that:

(a) you are over the age of 18;

(b) you will be responsible for ensuring that riding members of your party understand and abide by the Track Rules and these Terms at all times, especially under 18s;

(c) all riding members of your party are over the age of 16; 

(d) if you are signing a disclaimer on behalf of a person under 18 and you are not that person’s parent or legal guardian, you confirm you have the authority directly from the child’s parent or legal guardian to sign the disclaimer.

2.3 Save for clause 2.2 above, and where the context suggests otherwise, the term ‘you’, ‘yours’ etc in the Terms includes members of your party, if there are any.

3. Disclaimers

3.1 All participating riders will be required to sign a disclaimer before riding. Any person who has not signed the disclaimer will not be allowed to ride.

3.2 Riders under the age of 18 must have the Track Rules explained to them by an adult responsible for them and have a disclaimer signed for them by a parent or legal guardian or person with authority from a parent or legal guardian to sign the disclaimer.

4. Track Rules

4.1 The Track Rules can be found at www.hirememoto.com/pages/rules-regulations 

4.2 Like all motorsports, motocross can be dangerous. Our Track Rules are designed to keep you and other riders and visitors safe. It is important that you read and understand our Track Rules before you ride.

4.3 You must abide by the Track Rules at all times and only participate in a session or experience if you are prepared to do this. You must always follow the instructions of our marshals and members of staff and any signage posted around the site.

5. Hire Booking Confirmation

5.1 All bookings require either a deposit or full payment at the time of booking. You are advised which type of payment at the time of booking. If only a deposit is taken, full payment in cleared funds will be required before the day of your session. Deposits are non-refundable unless we agree otherwise.

5.2 Our bikes and track are subject to availability. No booking is accepted unless it is confirmed by us in writing. Usually, we send you an email confirmation. If you do not receive an email confirmation, please call us.

5.3 You must advise us as soon as possible of any mistake in the booking confirmation.

5.4 We shall use reasonable endeavours to ensure that your sessions start and finish at the times prescribed at booking but session times are approximate and not guaranteed.

5.5 It is your responsible to turn up on time, and to ensure that riding members of your party do the same. We advise you turn up at least 60 minutes in advance of your session starting. Late arrivals may not be permitted to participate in a session and no refunds or compensation will be payable in such circumstances.

6. Arrive and Ride Sessions

6.1 Arrive and ride sessions are booked in 15 minute slots, although your actual ride time may be slightly less depending on numbers on the track. These must be booked in advance online unless we agree otherwise.

6.2 When booking, you will be asked to participate in a beginner, intermediate or advanced group. Please pick a group that is appropriate to your level of skill and experience. If you are in any doubt as to what group to choose, please contact us in advance of your session.

6.3 You must have your own equipment to book and participate in an arrive and ride session. This includes goggles (not sunglasses), helmet, riding boots, gloves, durable clothing that covers arms and legs, chest and back protection (to at least ACU standard). Your equipment must be appropriate and free from defects and is your responsibility; for more information, please see our Track Rules.

6.4 When booking an arrive and ride session, we will assume that you know how to ride. We do not provide coaching, although we will give a short introduction to our electric bikes if you ask us to.

7. Experience Days

7.1 Experience days are booked for a minimum hire period of one day (approx. 09:00 – 17:00) and are for between 8 and 12 riders.

7.2 We will supply all participants with the right equipment and PPE including goggles, helmet, riding boots, gloves, durable clothing that covers arms and legs, chest and back protection (‘Our Equipment’).

7.3 Riders will only be permitted to participate if they wear and use Our Equipment (or their own which complies with our Track Rules) appropriately and safely at all times. You undertake to reimburse us the cost of replacing any part of Our Equipment which is damaged or lost as a result of your negligence or breach of these Terms.

7.4 Our experience days are designed to accommodate all levels of ability, from first time riders to experienced riders. Our ACU approved coaches will provide assistance to ensure that all riders are familiar with the bike’s basic controls, but to ride you must be: reasonably physically fit, able to understand and follow our Track Rules; able to pick the bike up to a balanced position on your own without assistance; able to sit astride the bike with one foot firmly on the ground. We reserve the right to refuse any rider access to the track (or withdraw them from participation) if we think they are unsafe, lack sufficient confidence or do not follow our Track Rules. Our decision is final on this point.

7.5 Experience days are about enjoying motocross in a safe and responsible way; they are not races, nor are they a grand prix. Safe overtaking is permitted, but reckless or dangerous riding, horseplay, rowdy or unruly behaviour, over-competitiveness or abuse of Our Equipment, bikes or track is not.

8. Health and Safety

8.1 By booking a session with us, you acknowledge that motocross can be dangerous and you, and all riding members of your party, agree that you ride at your own risk. Accidents can result in serious injury and can even be fatal. You acknowledge that there are risks in the sport you are about to undertake.

8.2 Moto101 reserves the right to refuse a rider the right to participate in a session, or remove a rider from a session, should it deem it necessary to do so. This includes a participant who does not comply with the Track Rules or who is deemed to be under the influence of alcohol or drugs or riding in a dangerous or reckless manner.

8.3 Riders who are refused participation or removed from a session are not entitled to a refund or to compensation. We also reserve the right to remove individuals who do not comply with the Track Rules from our site. In serious or repeated instances, we also reserve the right ban individuals from the site.

8.4 Moto101 is a practice track. However, motocross requires a degree of skill, strength, endurance and technical knowledge of the sport. Riders must not participate if they feel uncomfortable doing so. You must ride to your own ability and not take unnecessary risks.

8.5 You are responsible for your own health and safety at all times. You must be over the age of 16 to ride our electric bikes.

8.6 You must be reasonably physically it and healthy to ride. In particular, you must not participate if you suffer from any medical condition that (a) inhibits your ability to ride safely (b) makes it dangerous for you to ride, or you have been advised by a medical practitioner not to participate in any extreme, dangerous, fast or physically demanding sport.

8.7 Due to the inherent dangers of motocross, we strongly recommend that pregnant women do not ride.

8.8 Never ride under the influence of drugs or alcohol.

8.9 Please wear appropriate clothing and footwear.

9. Briefings

9.1 Safety briefings will be provided before entry to the track and are mandatory for all riders, including those with riding experience. You must pay attention to the safety briefings and follow the instructions of our coaches and marshals at all times. Do not assume you know everything; when in doubt, ask.

9.2 If we do not think that you paid attention to the safety briefing, we may ask that you and your party re-watch it. If we still do not think you have paid attention, we may cancel the session or experience for you and your party without a refund or compensation.

10. Our bikes

10.1 Our electric bikes are lightweight, green, easy to use and exciting, so please treat them with the respect that they deserve. If you are interested in buying an electric bike, we can help with that so please contact a member of our sales team.

10.2 Our bikes are hired to you, but owned by us. While under your control, you are responsible for them. Please take care of our bikes at all times. Do not abuse them. Your use of our bike is subject to our discretion. If we think that you are acting a way that might cause damage to one of our bikes, then you agree to immediately return the bike back to us if we ask you to. You may not be given a refund or a replacement.

10.3 The maximum speed of our electric bikes will be controlled by a built-in limiter which we operate remotely. We will set the maximum speed of the bike for each rider differently depending on our assessment of the rider’s experience, skill, confidence and adherence to the Track Rules. Our decision on this is final. We reserve the right to alter the limiter remotely without warning if we think it is appropriate to do so. Please note: for Experience Days, this means that riders will not necessarily be participating on the track at the same time with the same speed bikes.

10.4 We will carry out a visual inspection of the bikes before they go out, but if you think there is something wrong, or the sound or performance of the bike changes during a session, please stop (safely) immediately and report to a marshal.

11. Cancellations and refunds

11.1 You can cancel a session without penalty with more than 48 hours’ notice. You will receive a refund, minus any booking fee, within thirty days of cancelling.

11.2 Where you cancel a session with less than 48 hours’ notice, you are not entitled to a refund. However, if we are able to move your session to another date and time, you may be entitled to a partial or complete credit at our discretion. 

11.3 You have no entitlement to a refund unless expressly stated in the Terms.

11.4 We may cancel your session at any time. Where we do this, we will notify you using the email address you have supplied with as much notice as practicable. You will be responsible for notifying other members of your party. Where we cancel your session because of circumstances beyond our control, such as serious incremental weather, you are entitled to a credit, which can be used by you for another Moto101 experience within one year.  We also announce track closures via our social media platforms, and we strongly recommend that you check these before you travel as email notification is not 100% guaranteed.

11.5 We usually operate sessions in incremental weather, save in extreme weather conditions or storms. You must take more care than usual if the track is wet or in incremental weather.

11.6 Payments made by debit or credit card will be refunded to the same card or, if the card has subsequently expired, by cheque.

12. Limitation of Liability – Your attention is particularly drawn to this clause

12.1 Nothing in these Terms will exclude any liability which cannot be excluded by law, such as, but not necessarily limited to, injury caused by our negligence, or fraud.

 

12.2 We do not accept any liability (howsoever arising and to the fullest extent permissible by law) for any loss or damage to your belongings, or equipment, which you bring at your own risk.

 

12.3 We do not accept any liability for any loss, damage or injury that is not reasonably foreseeable as a result of our negligence or breach of duty or which is of an indirect or consequential nature. Our total aggregate liability is limited to the level of our public liability insurance cover from time to time.

 

12.4 We are not responsible for any loss, damage or injury caused directly or indirectly as a consequence of you doing something which we have advised you not to do, or omitting to do something which we have told you to do, whether that something is set out in these Terms or otherwise.

 

12.5 We do not accept any liability for any loss, damage or injury caused to you as a result of you failing to abide by these Terms or the Track Rules.

 

12.6 In addition to the specific exclusions above, you agree that we are not liable for any loss, damage, cost, liability, or injury you sustain because of something occurring that was not within our reasonable control to prevent.

 

12.7 Use of our car park is at your own risk. We do not accept liability for any loss or damage to your vehicle, or personal belongings in it, while you are parked in our car park. We do not guarantee that car parking spaces are always available.

 

13. Data Protection

 

13.1 We take data protection seriously. Your personal information will be stored safely by us in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulation. For more information about how we store and use your personal information, or exercising your statutory rights, please see our Privacy Policy.

 

13.2 Please be aware that we operate CCTV throughout the site, including in the briefing room. This is for the purposes of crime detection and prevention, the safety of our staff and riders and to ensure that our Track Rules are adhered to.

 

9. Photographs and videos

 

14.1 You may take photographs and video recordings at our site for your own personal use provided that you act responsibly and keep to the rules set out in the Terms. However, please respect other people’s privacy. Anyone who can be identified in your photographs or videos must be aware that you are filming them and you must get their permission first.

 

14.2 If another person is unhappy that you are filming them and makes a complaint to us, we may ask you to show us any images which you have taken on our site and to delete them if appropriate. If a member of our team asks you to stop filming or taking photographs, you must do so.

 

10. Miscellaneous

 

15.1 Only the parties to this contract may enforce these terms and conditions. This includes you, us and members of your party. This agreement is personal to you and may not be assigned or transferred to any third party.

 

15.2 This is the entire agreement relating to its subject matter. You acknowledge that you have not been induced to enter into this agreement based on any representation that we or anybody else has made. No other terms apply.

 

15.3 If any of these terms are determined to be illegal, invalid or otherwise unenforceable, it shall be severed and deleted from these Terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.

 

15.4 Your statutory rights are not affected by these Terms.

17. Law and Jurisdiction

17.1 These terms and conditions are governed by the laws of England and any dispute about them shall only be dealt with by the courts of England and Wales.
